2. Purpose and acceptance

This legal notice governs access to, browsing of and use of the website www.happyideas.com, owned by Happyideas Home S.L. (hereinafter, "Happyideas"). Accessing and using the website confers the status of user and implies full and unreserved acceptance of all the provisions of this legal notice from the moment of access.

The purchase of products through the shop is also governed by the general terms and conditions of sale. The processing of personal data is detailed in the privacy policy, and the use of cookies in the cookie policy.

Happyideas reserves the right to modify at any time the presentation, configuration and contents of the website, as well as this legal notice, and users are therefore advised to read it periodically.

3. Intellectual and industrial property

All the contents of the website — texts, photographs, graphics, images, icons, technology, software, graphic design and source code — constitute a work owned by Happyideas Home S.L. or by third parties who have authorised its use. None of the exploitation rights recognised by the intellectual property legislation in force may be understood as assigned to the user.

The trademarks, trade names and distinctive signs appearing on the website belong to Happyideas Home S.L. or to third parties, and access to the site may not be interpreted as granting any right over them.

The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of the contents of the website is prohibited without the express written authorisation of Happyideas Home S.L.

4. Protection of personal data

Users' personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation (GDPR), and with Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD).

Purposes: to manage user registration and the customer account; to process, deliver and invoice orders; to deal with enquiries and requests for information; and, where the user has consented, to send commercial communications about products and promotions.

Legal basis: performance of the contract of sale or of pre-contractual measures requested by the user (Art. 6.1.b GDPR); compliance with legal obligations, in particular tax and accounting obligations (Art. 6.1.c GDPR); the consent of the data subject for sending commercial communications and for the use of non-essential cookies (Art. 6.1.a GDPR); and the legitimate interest in site security and fraud prevention (Art. 6.1.f GDPR).

Retention period: data is kept for as long as the commercial relationship lasts and, once it ends, for the limitation periods laid down by law in order to address any liabilities. Data processed on the basis of consent is kept until the user withdraws it.

Recipients: data may be disclosed to the transport companies responsible for delivery, to the financial institutions and payment gateways involved in collecting payment, and to the tax authorities where there is a legal obligation. Technology providers who access personal data do so as data processors, under the contract provided for in Article 28 GDPR. No international transfers of data outside the European Economic Area are made without the appropriate safeguards provided for in Chapter V GDPR.

Users may also lodge a complaint with the Spanish Data Protection Agency (C/ Jorge Juan 6, 28001 Madrid, www.aepd.es) if they consider that the processing does not comply with the regulations in force.

Security measures: Happyideas Home S.L. applies the appropriate technical and organisational measures provided for in Article 32 GDPR to guarantee a level of security appropriate to the risk and to prevent the alteration, loss, unauthorised processing of or access to the data.

5. Cookies

This website uses its own and third-party cookies. The technical cookies necessary for the site to work are installed automatically; the rest are only installed with the user's prior consent, which can be given, refused or withdrawn from the cookie settings panel. 6. Disclaimer

A. Happyideas is not liable for damages of any nature arising from the unavailability or discontinuity of the website's operation, nor for those that may be due to a lack of truthfulness, accuracy or currency of the contents, without prejudice to the rights that consumer legislation grants to consumers and users.

B. Happyideas makes every effort to avoid errors in the contents published and to correct them as quickly as possible once detected.

C. Happyideas does not guarantee the absence of interruptions or errors in accessing the website or its contents, nor that these are always up to date, although it will take the necessary steps to remedy or update them.

D. Accessing the website does not imply any obligation on Happyideas to check for the absence of viruses or other harmful software. It is the user's responsibility to have appropriate tools for detecting and disinfecting harmful programs.

E. Happyideas is not responsible for damage caused to users' or third parties' computer equipment while the website service is being provided.

F. Happyideas is not liable for damages arising from improper use of the website by users or from their failure to comply with the legislation in force.

G. The website may include links to third-party pages. Happyideas exercises no control over those sites and is not responsible for the lawfulness, quality, reliability or accuracy of their contents, which are the sole responsibility of their owners.

H. Happyideas is not responsible for viruses originating in a telematic transmission infiltrated by third parties with the aim of producing negative results for a computer system.

7. Applicable law and dispute resolution

This legal notice is governed by Spanish law. Any dispute arising from access to or use of the website will be heard by the courts and tribunals determined in each case by the applicable regulations; where the user is a consumer, the courts of their place of residence will have jurisdiction, in accordance with the consolidated text of the General Law for the Defence of Consumers and Users.

The European online dispute resolution (ODR) platform ceased to operate on 20 July 2025, following the repeal of Regulation (EU) No 524/2013 by Regulation (EU) 2024/3228. Consumers may send their complaints directly to [email protected] and, if these are not resolved to their satisfaction, may turn to the consumer arbitration boards, the municipal consumer information offices (OMIC) or, for cross-border purchases within the European Union, the European Consumer Centre in Spain.
